Nevada’s Two Year Deadline
Most personal injury lawsuits in Nevada must be filed within two years of the accident date. Acting early helps preserve evidence and protect the claim.
Nevada’s Modified Comparative Negligence Rule
Nevada law allows accident victims to recover compensation even when they share part of the blame. This rule, known as modified comparative negligence under Nevada Revised Statutes 41.141, is one of the most important concepts in any Nevada personal injury case.
An injured person can recover damages as long as their percentage of fault is not greater than the combined fault of the other parties. Recovery is reduced by that percentage of fault. At 51 percent or more, recovery is barred entirely.
A Real Example of How This Works
A driver making a left turn is struck by an oncoming vehicle that ran a red light. A Clark County jury finds the oncoming driver seventy percent at fault and the turning driver thirty percent at fault. If total damages are one hundred thousand dollars, the turning driver recovers seventy thousand dollars. If the same jury found the turning driver fifty-one percent at fault, recovery would be zero.
Damages Available in Nevada Personal Injury Cases
When liability is established, Nevada law allows recovery for medical expenses, lost earnings, loss of earning capacity, pain and suffering, and emotional distress. Punitive damages may also apply in cases involving oppression, fraud, or malice under Nevada Revised Statutes 42.005.
Nevada’s Statute of Limitations
Most personal injury claims in Nevada must be filed within two years of the accident date under Nevada Revised Statutes 11.190. Deadlines can vary by case type, including claims involving medical malpractice, government entities, minors, or delayed discovery of an injury.
